{"id":3143,"date":"2022-11-18T16:57:45","date_gmt":"2022-11-18T11:57:45","guid":{"rendered":"https:\/\/dicecamp.com\/insights\/?p=3143"},"modified":"2022-11-18T17:19:32","modified_gmt":"2022-11-18T12:19:32","slug":"google-privacy-settlement-in-us","status":"publish","type":"post","link":"https:\/\/dicecamp.com\/insights\/google-privacy-settlement-in-us\/","title":{"rendered":"Google constrained of $391m privacy settlement for breaking state laws"},"content":{"rendered":"\n<p class=\"has-small-font-size\"><em>Image by <\/em><a href=\"https:\/\/www.pexels.com\/photo\/black-and-gray-digital-device-193003\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Torsten Dettlaff<\/em><\/a><em>\/Pexels&nbsp;<\/em><\/p>\n\n\n\n<p><strong>November &#8217;22 marks a significant milestone in consumers privacy protection for the US, as <\/strong>t<strong>he multi billion dollars company has come under the law<\/strong>.<\/p>\n\n\n\n<p>On Monday, the <em><a href=\"https:\/\/www.doj.state.or.us\/media-home\/news-media-releases\/largest-ag-consumer-privacy-settlement-in-u-s-history\/\" target=\"_blank\" rel=\"noreferrer noopener\">Oregon\u2019s Department of Justice<\/a><\/em> announced that it along with 39 other US states will receive a combined $391.7 million in return for dismissing the privacy litigation against Google, which was made in 2018.&nbsp;<\/p>\n\n\n\n<p>The privacy allegation on Google was that \u201c<em>[it] misled its users into thinking they had turned off location tracking in their account settings, when, in fact, Google continued to collect their location information<\/em>.\u201d, stated the press release.<\/p>\n\n\n\n<p>As the verdict is announced, Google has agreed to significantly improve its location tracking disclosures and user controls starting in 2023.<\/p>\n\n\n\n<p>Google is required to become explicitly <strong>transparent<\/strong> in its data collection procedure, states the settlement. This means, from now onwards, Google must:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Inform users of what it means for their data privacy when turning location services \u2018on\u2019 or \u2018off\u2019;<\/li><li>Clearly state when Google services require \u2018unavoidable location tracking\u2019 instead of keeping this hidden from users; and<\/li><li>Give detailed information to users about the types of location data Google collects and how it\u2019s used, on a dedicated webpage.<\/li><\/ol>\n\n\n\n<p>The case was opened in 2018, when the attorney generals from the<em> US Department of Justice<\/em>, majorly <a href=\"https:\/\/www.doj.state.or.us\/media-home\/news-media-releases\/largest-ag-consumer-privacy-settlement-in-u-s-history\/\" target=\"_blank\" rel=\"noreferrer noopener\">AG of Oregon<\/a> and Nebraska, started investigating the case after an independent press article rebutted Google\u2019s illegal tracking of location information.&nbsp;<\/p>\n\n\n\n<p>The Associated Press- AP, an independent global news organization, debunked Google\u2019s illegal <a href=\"https:\/\/apnews.com\/article\/north-america-science-technology-business-ap-top-news-828aefab64d4411bac257a07c1af0ecb\">tracking<\/a> of user\u2019s personally identifiable location data for advertising purposes.<\/p>\n\n\n\n<p>The investigation\u2019s credibility weighs on the fact that it involved computer scientists from <em>Princeton university<\/em> who discerned Google\u2019s attempt of tracking people\u2019s whereabouts even though users opted out of Location Tracking.<\/p>\n\n\n\n<p>In other words, Maps and other Google services on Android and iPhones; such as search browser and Play store applications, have been tracking its users with a separate \u2018Tracking Location\u2019 control that was turned \u2018on\u2019 by default.<\/p>\n\n\n\n<p>What\u2019s disruptive is that Google has been misleading its users in this manner since 2014, found the investigation.<\/p>\n\n\n\n<p>As some examples, Maps stored a user\u2019s current location right at the moment of opening the application; the weather update services always calculated users&#8217; location to accuracy; and some applications such as \u2018Chocolate Chip Cookies\u2019, where location tracking is completely irrelevant, measured user\u2019s longitude and latitude to accurately mark their place of presence. All this data was saved on user\u2019s google account.<\/p>\n\n\n\n<p><strong>How does it matter?<\/strong><\/p>\n\n\n\n<p>Minute-by-minute tracking of user\u2019s transit is against their basic privacy rights and might create drastic consequences for them. As for the case of Google, Police in North Carolina had warrant the tech giant to share location information of all devices in the proximity of a crime scene, highlighted in AP&#8217;s investigation.<\/p>\n\n\n\n<p>\u201cConsumer privacy is one of my office\u2019s top priorities.\u201d remarked AG Rosenblum during the proceedings.<\/p>\n\n\n\n<p>And for that, the consumer protection (CP) task force is working on yet another remarkable legislation that plans to further the control users have on their online privacy. If this bill, slated for 2023\u2019s Legislative Session, is successfully passed, it\u2019ll bound companies to provide users with: information about what data the company is sharing; to whom and where their data was disclosed; delete option, or making corrections to their data.<\/p>\n\n\n\n<p>While Google is under Radar for long now, to make things better the search giant recently rolled out an innovative privacy enabled advertising system called <a href=\"https:\/\/dicecamp.com\/insights\/google-moves-to-protect-user-privacy-on-android-apps\/\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"Google moves to Protect User Privacy on Android Apps\">Privacy Sandbox.<\/a> Learn how Google plans to enable advertising without user data leaving their devices, thus giving zero control to the company or advertisers on the data.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Google has been deceptive.
